These terms of use (the "Terms") govern access to and use of the Horizon Oncology Modelling Platform (the "Platform"), operated by Horizon Health Economics ("Horizon", "we", "us"). The Platform is made available to invited users only, including users granted trial access under Section 10, for the purposes of evaluation described in Section 3. By selecting "I have read and agree" and proceeding to sign in, you agree to be bound by these Terms. If you do not agree, do not proceed.
1. Service status
The Platform is under active development. Features may be incomplete, contain errors, change without notice, or be withdrawn. Availability is not guaranteed, and saved work may be modified, lost, or deleted at any time. The Platform is provided for evaluation and is not represented as suitable for any other purpose.
2. Access and accounts
Access is personal to you as an invited user. You must keep your login credentials confidential, must not share access with any other person, and must notify us promptly if you believe your access has been compromised. You must not hand your access, or a session you have signed in to, to software any more than to another person (Section 3(f)). We may suspend or withdraw access at any time without notice and without reason.
3. Permitted use
You may use the Platform solely to explore and evaluate its functionality and to provide feedback to Horizon. You must not: (a) rely on the Platform or its outputs for any clinical, commercial, pricing, reimbursement, regulatory, or other decision; (b) use the Platform to provide services to third parties; (c) attempt to probe, disrupt, or test the security of the Platform; (d) copy, adapt, decompile, or reverse engineer any part of the Platform except as permitted by law; (e) use the Platform in breach of any applicable law; (f) operate the Platform by automated means, including scripts, bots, browser-automation tools or artificial-intelligence agents that navigate, click, type in or submit anything on the Platform, or allow any such tool to operate the Platform on your behalf, unless Horizon has agreed in writing; (g) submit screens, outputs, documentation or other content of the Platform to an artificial-intelligence service, other than one your organisation provides to you under enterprise terms that stop the content being used to train models (submitting it to any other artificial-intelligence service is a disclosure to a third party); (h) publish, or disclose to any third party, a comparison of the Platform's results or performance with those of any other product, without Horizon's prior written consent (comparing the Platform with other products for your own organisation's internal evaluation is permitted); or (i) use the Platform to build, or to help build, a product or service that competes with it.
Paragraphs (f) and (g) do not restrict assistive technology you use because of a disability, such as a screen reader, a screen magnifier or voice control; your browser's or operating system's own reading, translation, spelling, accessibility or security features; or your organisation's security and data-loss-prevention software. Horizon may give the written agreement mentioned in paragraph (f) to any person, including testers Horizon engages.
Horizon records how the Platform is used, as set out in its privacy notice, to keep the Platform secure and to check compliance with these Terms.
4. No confidential or personal data
You must not upload, enter, or store any confidential information, any proprietary third-party data, or any personal data (including patient-level data that identifies, or could be used to identify, a living individual) on the Platform. Any patient-level data used for testing must be fully anonymised, synthetic, or publicly available. You are solely responsible for ensuring that anything you upload may lawfully be used in this way. Horizon does not act as a processor of personal data on your behalf in connection with the Platform and accepts no responsibility for material uploaded in breach of this section.
For the avoidance of doubt, Horizon's permitted processing of data uploaded in accordance with this section is limited as described in Section 5 and does not give Horizon any right to use or repurpose that data for its own purposes.
5. Your content and our platform
You retain all rights you hold in any data or other content you upload to the Platform ("User Content"). Horizon does not acquire any ownership rights in User Content.
You grant Horizon a limited, non-exclusive licence to host and process User Content solely to the extent necessary to provide, operate, secure, maintain and support the Platform and to generate outputs requested by you.
Horizon will not use or repurpose User Content for any other purpose. In particular, Horizon will not use User Content for its own research, benchmarking, commercial analysis, development of datasets or models, training of artificial intelligence or machine-learning systems, marketing, or for the benefit of Horizon or any other customer or third party. Horizon will not sell, license or otherwise commercialise User Content.
Horizon may disclose or make User Content accessible only where necessary to service providers supporting the operation or hosting of the Platform, subject to appropriate confidentiality and security obligations, or where required by law.
The Platform itself, including its software, design, methods, algorithms and documentation, is and remains the property of Horizon and its licensors. Any feedback, suggestions or ideas you voluntarily provide about the Platform may be used by Horizon without restriction or obligation to you, provided that such feedback does not include or disclose User Content.
6. Outputs are not advice
Results produced by the Platform depend entirely on the data, assumptions, and settings supplied by the user. Outputs are illustrative, are not validated for decision-making, and do not constitute professional, clinical, health-economic, or financial advice. You are responsible for any use you make of them.
7. No warranty
The Platform is provided "as is" and "as available", without any warranty or condition of any kind, express or implied, including any warranty of accuracy, completeness, fitness for a particular purpose, availability, or non-infringement, to the maximum extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, Horizon shall have no liability arising out of or in connection with your use of, or inability to use, the Platform, whether in contract, tort (including negligence), or otherwise, including for loss of data, loss of profit, or any indirect or consequential loss. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, or for fraud.
9. Suspension, withdrawal, and changes
We may suspend, restrict, or withdraw the Platform, remove features, reset stored data, or amend these Terms at any time. If these Terms change materially, you will be asked to accept the updated version before continuing to use the Platform. Sections 4 to 8, and the restrictions in Section 3(g) to (i), survive the end of your access to the Platform, including the end of any Trial Access.
10. Trial access
Horizon may grant time-limited access to the Platform to a person who requests it ("Trial Access"). If you use the Platform under Trial Access, this Section applies in addition to the rest of these Terms and prevails over them where the two conflict.
Duration. Trial Access lasts 14 days. The period starts when your request is approved or, where your welcome email says so, when you first sign in. The date and time at which it ends are shown in the Platform. Trial Access ends automatically at that time, including in any session that is still open. Each session under Trial Access also closes automatically after at most 2 hours; you may sign in again while Trial Access lasts.
Nothing is saved. Under Trial Access the Platform does not save, share or keep any analysis you create or change. Your work lasts only while your browser tab is open, and it is lost when the tab is closed, when the session ends or when Trial Access ends, whichever comes first. You may download the tables and charts that the Platform offers for download.
Worked examples. The worked examples offered during Trial Access are illustrative only. Their treatments, efficacy and prices are fictional and do not describe any real medicine or any real price. Their results must not be quoted or relied on as evidence about any product.
Uploaded data. Section 4 applies in full, and the rule is the same for every user of the Platform: any data you upload during Trial Access, including patient-level data uploaded to fit survival curves, must be anonymised or synthetic (for example, reconstructed from published survival curves) and must not identify any individual, or be capable of being used, alone or together with other information, to identify any individual. Pseudonymised patient-level data, in which names or other identifiers are replaced by codes, is still personal data under UK GDPR and may not be uploaded by anyone.
Restrictions. Section 3 applies to Trial Access in full, including its restrictions on automated tools, artificial-intelligence services, comparisons and competing products in paragraphs (f) to (i).
Ending Trial Access. Horizon may end, suspend or shorten Trial Access at any time, without notice and without giving a reason. Trial Access does not entitle you to an extension, to further access or to a paid subscription.
Your details. Horizon keeps the details you gave in your
request, your acceptance of these Terms and a record of your sign-ins and
sessions (the security records described in Horizon's privacy notice) for the
periods and purposes set out in that notice, published on the Horizon website

11. General
These Terms constitute the entire agreement between you and Horizon in relation to the Platform, including any Trial Access, and are governed by the laws of England and Wales, whose courts have exclusive jurisdiction.
